Different roles. Shared responsibility.

Use this guide alongside your association’s governing documents and the notice for your case. CCR means covenants, conditions and restrictions. This training addresses Florida homeowners’ associations under Chapter 720.

Board members

Verify the governing rule, evidence and proposed fine. Appoint an eligible independent committee. Preserve the Board’s action and provide a complete referral.

Committee members

Listen impartially, evaluate the evidence and cure status, and confirm or reject the Board’s proposal. You do not negotiate a different amount.

Read the allegation and cure instructions. Prepare your response and evidence. You may attend by telephone or other electronic means.

Prepare a complete case

Identify the exact governing provision, alleged conduct, incident dates, evidence and Board-proposed fine. Check the current cure status before proceeding.

Preparation and safeguards
  • Document the Board action, fine amount and any continuing-violation calculation.
  • Check statutory fine limits and governing-document authority. The default is $100 per violation and $1,000 in the aggregate unless the governing documents provide otherwise.
  • Screen for prohibited fines, including protected garbage-receptacle timing and the special notice period for holiday decorations.
  • Verify at least three eligible Board-appointed committee members. Officers, directors, employees and their spouses, parents, children, brothers and sisters are ineligible.
  • Establish the applicable quorum and voting rules before the hearing.

Give proper notice and access

Send the individual written hearing notice to the required recipients at their designated addresses. Include the allegation, applicable cure action, hearing details and remote access.

Notice preparation
  • Provide at least 14 days’ written notice and hold the hearing within 90 days after notice issuance.
  • Include the owner and any applicable occupant, licensee or invitee sought to be fined.
  • Verify mailing or email details in the official records and preserve delivery evidence.
  • Prepare the community meeting notice and agenda under the rules applicable to this committee. A community posting does not replace the individual notice.
  • Give owners working telephone or electronic participation details.

Conduct a fair hearing

Confirm eligibility, notice and quorum. Hear each case separately. Present the evidence, give the owner an opportunity to respond, and consider any proof of cure.

Chairperson’s running order
  1. Call the meeting to order when quorum is established and explain the committee’s limited role.
  2. Identify the case, record owners and representatives present or absent.
  3. Review the Board action, governing provision, notice and exhibits.
  4. Invite the owner’s response and relevant questions.
  5. Deliberate, record findings and take the required vote.
  6. Announce the disposition and assign written findings and follow-up.

An owner’s absence is not proof of a violation. Stop for a material notice, eligibility, quorum or access defect; do not record a decision that did not occur.

Record the actual decision

Record the evidence considered, material owner response, cure status, individual votes and outcome. The committee may confirm or reject the proposal; it may not substitute a different fine.

Decision checks

A fine may not be imposed if the required approval is not obtained, or if a qualifying cure bars it. Distinguish a majority rejection from a failure to obtain approval. Use the actual vote and reason.

If an approved fine remains uncured, the committee sets the lawful payment date. Do not treat approval as permission to collect immediately.

Send findings and close the record

Provide written findings within 7 days after the hearing. Send the correct owner letter with the findings attachment, report to the Board, and retain delivery proof.

Follow-up responsibilities
  • Include the findings, result, applicable cure instructions and any payment date.
  • For an approved, uncured fine, allow at least 30 days after delivery of the written findings before payment is due.
  • Recheck qualifying cure and delivery before posting or collecting a fine.
  • Complete the minutes, update the violation record and assign accounting instructions for the exact lawful amount—or no charge.
  • Keep notices, exhibits, owner submissions, votes, letters and delivery records together.

The payment clock starts at delivery. These intervals do not create one fixed schedule. We use the actual issuance, hearing and delivery dates to track each case.

APPROVED & UNCURED

Set a lawful due date

Payment is due only if the fine remains legally imposable. A qualifying cure still bars it.

Use: approved owner letter + findings.

Can the committee reduce a $300 proposed fine to $100?
No. Its role is to confirm or reject the Board’s proposed fine. A different proposal requires the appropriate separate process.
Can an approved fine be collected after a qualifying cure?
No. Cure before the hearing, or in the manner specified in the required written notice, bars imposition. Document the cure and coordinate the appropriate account instruction.
Does the 30-day payment period start on the hearing date?
No. The payment date must be at least 30 days after delivery of the written findings, when an approved fine remains uncured and legally imposable.

Decision letters

Letter selection: Attach the written findings to the appropriate owner decision letter. The Board reports are separate communications. Use the cure/failed-approval letter when that is the actual basis; do not label it a rejection unless the committee voted to reject.
