Know the enactment and the present question
HB 913 became Chapter 2025-175, generally effective July 1, 2025 except as otherwise provided. The legislation addressed condominium and cooperative associations and related management subjects. This guide focuses on current condominium reserve planning, using section 718.112 rather than assuming that every provision applies equally to HOAs or cooperatives.
For Northwest Florida condominium boards, the central question is how the required study, repair priorities and funding plan fit together. A new financing option does not eliminate the underlying obligation to maintain the building or accurately disclose the association's financial plan.
Confirm the deadline before promising more time
Current law generally required qualifying existing owner-controlled associations to complete a SIRS by December 31, 2025. A qualifying association required to complete a milestone inspection by December 31, 2026 may coordinate the study with that inspection, subject to the statutory limit. The December 2026 date is not a blanket extension.
The statute also has specific provisions involving milestone repairs and study timing. Those provisions need review against the actual inspection date and association facts. A board should obtain a written applicability analysis before telling owners that a study or contribution may be postponed.
Funding methods must match the study
Current section 718.112 permits specified SIRS reserve funding through regular assessments, special assessments, lines of credit or loans. Relevant special assessments and borrowing require the statutory approval, and some associations are excluded from particular options. A lender's willingness to offer financing does not establish that the board has authority to accept it.
The study must account for the selected funding method and its effect on the funding schedule. If the proposed budget does not align with the current study's plan, an updated study is required before adoption under the statute. Owners should be able to see how contributions, borrowed funds, repayment and planned work fit together.
The general reserve threshold was changed to a $25,000 base with annual adjustment; DBPR lists $25,675 for 2026. That threshold is not an exemption for every cheaper component. Mandatory categories and SIRS component rules still matter. Do not invent a 2027 adjustment before DBPR posts it.
Board checklist
Confirm building applicability and deadline. Obtain the latest completed study and compare its assumptions with current balances. Identify the specific statutory funding option and required approval. Model repayment alongside operating expenses. Update the study when required. Calendar owner distribution or availability notice and the DBPR completion statement within 45 days after receipt. Retain approval evidence and the receipt affidavit.
Use qualified reserve, accounting and legal professionals together when choosing among financing options. This article does not evaluate a particular loan or authorize a board to waive required reserves; it identifies the questions that must be answered before a funding decision is presented as compliant.
