Scope comes before a deadline

Chapter 720 regulates qualifying Florida homeowners associations. It should be read with the recorded governing documents and the statute's scope provisions, including section 720.302. A Northwest Florida board should first confirm that it is a Chapter 720 association rather than a condominium, cooperative, voluntary civic group or another legal arrangement.

That initial classification matters. Condominium election rules, condominium reserve-study requirements and condominium fine limitations are not interchangeable with HOA provisions. Nor does incorporation under Chapter 617 erase the more specific community-association requirements.

A section-by-section working map

Section 720.303 is the operating hub. It addresses board meetings, minutes, official records, budgets, financial reports and association funds. Records access generally must be provided within 10 business days of a written request. Associations with at least 100 parcels must maintain specified documents through an online site or application, with protected access and appropriate screening of excluded information.

Section 720.305 governs fines and suspensions. The board's proposal and the hearing committee's role are separate. The statute requires notice and an opportunity for a hearing, and a rejected fine cannot be imposed. Cure provisions and payment timing are part of the process, not optional customer-service additions.

Section 720.3035 governs architectural control. Authority must come from the declaration or authorized published standards, and the association must apply standards reasonably and equitably. Written denials must identify the controlling provision and the nonconforming part of the application. Since July 1, 2026, a governmental building permit cannot be demanded as a prerequisite to architectural review.

For member meetings, elections and amendments, begin with section 720.306. For developer transition, begin with section 720.307. For assessment collection, section 720.3085 is a starting point, but a collection decision also needs the documents, an accurate ledger, required notices and attorney review. A statute index is not a ready-to-use foreclosure checklist.

Apply the map to an actual decision

Suppose an owner requests a patio improvement and also asks for the current architectural standards. Treat the application and records request as separate workstreams. Confirm the architectural authority, log the records deadline, schedule any required committee meeting and communicate the outcome using the appropriate procedure. Do not postpone all responses until the next annual meeting.

Board checklist: confirm association type; identify the exact section and document provision; determine the decision maker; select the correct notice; retain the supporting records; and document the vote or written decision. Review a statutory change for its actual effective date before modifying an existing process.

The goal is a repeatable method that owners can understand and future directors can follow. Consistency begins with the correct authority, not with repeating what a prior board happened to do.
