Identify the version that is actually effective
Florida’s official rule register identifies the current amendment to Rule 61B-22.005 as effective October 4, 2026. A separate proposed amendment was published October 22, with comments open through November 12, 2026. As of this guide’s November 4 review, that proposal is not the adopted rule. Boards should not change funding procedures solely because proposed language appears on the same official page.
This is a condominium reserve rule implementing Chapter 718. It should not be presented as an automatic requirement for a Chapter 720 detached-home HOA. Northwest Florida condominium boards must first determine their statutory reserve and structural integrity reserve study obligations, including the characteristics of their buildings and the applicable statutory exceptions.
Distinguish a full study from an update
The adopted rule recognizes a full structural integrity reserve study, an update with a site visit and a financial update without a site visit. Only a full study encompassing the statutory items and requirements satisfies the recurring ten-year full-study requirement. A financial spreadsheet update does not restart that obligation as though a new full inspection had occurred.
A reserve-schedule update without a new visual inspection is permitted under specified conditions, including a recent visual inspection within the preceding 36 months and limited changes to funding amounts or estimated replacement costs. The rule separately addresses updates solely involving a funding-method change. It also requires visual inspection after an incident or disaster reasonably expected to affect structural integrity or life-safety systems.
Other adopted triggers require attention. An updated SIRS is required when projected year-end reserve balances differ by at least the specified 50-percent measure of annual reserve cash inflows. A repair, replacement or maintenance schedule deviation of more than two years also triggers an update. Ask the qualified preparer to apply the exact rule rather than using an informal materiality judgment.
Use the adopted forms and complete delivery
The rule incorporates DBPR Form CO 6000-10 for SIRS and Form 6000-11 for the affidavit of acknowledgment. The official register provides adopted references 19575 and 19576. Use those adopted documents, not a proposed form or an older downloaded copy with a similar name.
A completed study is signed, dated and delivered by the licensed professional or qualified company that performed it. An internal preliminary draft is not the completed study for these purposes. The association must handle owner availability or distribution and Division notice under the cited statutory provisions, using its online account for the required reporting. Material amendments can require renewed compliance; filing the initial study does not end the reporting workflow.
The rule requires implementation and funding in accordance with the most recent SIRS and prohibits manipulating its findings. A board should not revise useful-life estimates merely to reach a preferred assessment amount.
Board checklist
Keep the adopted rule and forms with the reserve file. Record the last full study and visual inspection dates separately. Compare actual balances and project timing with the study. Log storm damage and major repairs. Assign responsibility for owner distribution, Division reporting and acknowledgment. Ask the preparer about update triggers before adopting the next budget, and monitor the proposal for a later final adoption rather than treating it as current law.
