Before filing a complaint with the county to recover possession, a landlord must serve a Three-Day Notice demanding payment of rent or possession of the premises within three (3) days (excluding Saturday, Sunday, and legal holidays) after the date of delivery of the notice.  After the expiration time on the service of the Three-Day Notice the landlord may proceed with filing the Complaint for Eviction. 

 

TENANT RECOMMENDATIONS:

If you are a tenant with a past due balance, we highly recommend you make a payment to bring your account current or contact the property manager to avoid the eviction process.  The laws allow for the tenant to surrender the premises and avoid the cost and embarrassement of eviction.  The eviction process takes an average 10-12 business days in Florida so if you are able to vacate the premises on or before the 10th of the month, most  landlords will accept a written agreement for you to vacate.  However, remember that you are still responsible for payments and obligations under the lease - so you will want to move quickly and leave the property in good condition as you will be getting the bill.
