Why am I Getting a Violation Notice?

More than a destination at the end of the day, a community is a place you want to call home and where you feel at home. There is a difference between living in a community and being part of that community. Being part of a community means sharing with your neighbors a common desire to promote harmony and contentment.

Because of the desire to promote harmony as well as maintain the integrity of the community, all Associations have “governing documents” that explain in detail, the homeowners rights as well as RESPONSIBILITIES.

"Governing documents" means the articles of incorporation, bylaws, plat, declaration of covenants, conditions, and restrictions, rules and regulations of the association, or other written instrument by which the association has the authority to exercise any of the powers provided for in this chapter or to manage, maintain, or otherwise affect the property under its jurisdiction.

The governing documents basically lay out the rules. As a homeowner you have access to these rules and it is assumed that you have familiarized yourself with them. When these rules that have already been established are broken, the Board of Directors will send out violations (with a chance to remedy) because it is their duty to the association as a whole to keep the entire Association in compliance.

When you receive a violation it will give you information about the violation as well as a time frame to remedy the situation. Most of the time you will be able to cross reference this with your governing documents and see that you were in violation of the rules. You simply need to correct the problem and see that it does not happen again.

 

If you receive a violation it is because you are not in compliance with the governing documents.

Homeowners Have the Responsibility To:

Read and comply with the governing documents of the community.

Maintain their property according to established standards.
